O’Melveny Secures Win for LG Electronics in Patent Case

SAN FRANCISCO—February 10, 2024—An O’Melveny team recently secured a case-ending victory in an AI-related patent case on behalf of client LG Electronics against Image Processing Technologies (“IPT”).

IPT filed the case in March 2022 in the Eastern District of Texas, asserting Claim 1 of US Patent No. 6,959,293, which describes using AI machine learning and statistical tools to detect features in images. IPT accused various AI-based facial and gesture detection features in LG smartphones, including “AI Cam” and “Gesture Shot.”

In the LG case, the O’Melveny team developed a strategy of construing Claim 1 broadly, so that it rendered invalid the claim based on prior work that the inventor of the ’293 Patent had authored. That strategy prevailed. The district court adopted LG’s construction of the claims in 2023, leading IPT to stipulate to a judgment of invalidity while seeking appeal to the Federal Circuit. In January 2025, the Federal Circuit affirmed the district court’s claim construction and reasoning in all respects.
